These Terms and Conditions (“Terms“) govern your use of gdpilots.com and the services offered through it. Please read them carefully. By creating an account, posting a vacancy, or otherwise using the website, you agree to these Terms. If you do not agree, please do not use the website.
These Terms are governed by the law of the Netherlands, as set out in our Netherlands Law — Legal Notice & Governing Law page.
1. Definitions
- Website — gdpilots.com and all its pages and services.
- We / us / GD Pilots — the operator identified in the Legal Notice.
- You / User — any person who visits or uses the Website.
- Visitor — a User who browses without an account.
- Employer — a User who registers an account in order to publish vacancies.
- Account — a registered employer account on the Website.
- Listing — a pilot vacancy published on the Website.
- Content — any text, images, links or other material submitted to the Website.
- Services — the facilities we provide, including publishing and displaying Listings.
2. About the service
GD Pilots is an online platform on which verified Employers can publish aviation pilot vacancies, and on which Visitors can find those vacancies. We provide a platform only. We are not an employer, a recruitment agency, or a party to any application, employment relationship, or contract that may result between an Employer and a candidate. We do not guarantee that a Listing will result in any applications, nor that a candidate will find a position.
3. Eligibility
To register an Account or post a Listing you must:
- be at least 18 years old and able to enter into a binding agreement; and
- be duly authorised to advertise vacancies on behalf of the company or organisation you represent.
By registering, you confirm that both conditions are met.
4. Accounts
4.1 Registration. Posting a Listing requires a verified Account. You must provide accurate, current and complete information during registration (including your name, company, position and a valid work email address) and keep it up to date.
4.2 Email confirmation. New Accounts are confirmed by email before they can publish. Your Account becomes active only after you follow the confirmation link we send you. We may also verify Accounts by other reasonable means.
4.3 One account; accurate identity. You may hold one Account for your organisation unless we agree otherwise. You must not impersonate any person or company or misrepresent your authority or affiliation.
4.4 Security. You are responsible for keeping your login credentials confidential and for all activity that takes place under your Account. Notify us promptly at crew@gdpilots.com if you suspect any unauthorised use.
4.5 Suspension. We may suspend, restrict or block an Account that we reasonably believe has breached these Terms or our Website Rules, that has not been confirmed, or that presents a security or fraud risk.
5. Posting vacancies
5.1 Your responsibility for Listings. You are solely responsible for the Content of your Listings. Each Listing must:
- describe a genuine, currently open aviation pilot vacancy;
- be accurate, complete and not misleading (including employer identity, role, location, requirements and any stated conditions);
- concern a role you are authorised to advertise;
- comply with all applicable law, including equal‑treatment and non‑discrimination law; and
- comply with our Website Rules.
5.2 What you must not do. You must not post fees payable by candidates, “pay‑to‑apply” schemes, pyramid or multi‑level‑marketing offers, non‑aviation or non‑pilot roles (except where we expressly allow a category), duplicate or spam Listings, or Content that is unlawful, infringing, deceptive or harmful. The full list is set out in the Website Rules, which form part of these Terms.
5.3 Our editorial rights. We may review, edit for formatting, decline, reclassify, or remove any Listing at our reasonable discretion — for example where it breaches these Terms or the Website Rules, or where it is incomplete, mis‑categorised or out of date. We are not obliged to publish any Listing.
5.4 Listing duration. Unless stated otherwise at the time of posting, a Listing is published for a fixed period of [60] days, after which it expires and may be removed or archived. You should remove or close a Listing once the role is filled or withdrawn.
5.5 Licence to display your Content. So that we can operate the Website, you grant us a non‑exclusive, royalty‑free, worldwide licence to host, store, reproduce, adapt for formatting, publish and display your Listing Content on and in connection with the Website for as long as the Listing is live (and for a reasonable period afterward in backups and archives). You confirm that you own or are authorised to grant this licence and that your Content does not infringe the rights of any third party.
6. Fees, payment and cancellation
Note for the site owner — remove before publishing. Your pricing model (one‑off fee per listing slot vs. recurring membership) is not yet finalised. Keep whichever of the two blocks below matches your decision, complete the bracketed details, and delete the rest and this note.
6.1 Paid services. Some Services (such as publishing a Listing) may require payment. Applicable prices, what they include and the payment terms are shown before you commit. Prices are stated in euros (EUR). Prices shown to consumers include VAT where applicable; prices shown to business customers may be stated excluding VAT, in which case VAT is added at checkout and shown clearly.
6.2 Payment. Payments are processed by our payment provider. We do not store your full card details. You agree to the payment provider’s terms when you pay. Access to the paid Service is granted once payment is confirmed.
6.3 Invoices and records. We issue an invoice or receipt for each paid Service and retain transaction records as required by Dutch tax law.
6.4 One‑off Listings. A paid Listing is a single purchase covering one vacancy for one publication period of 60 days. It does not renew automatically. To publish again, you purchase a new Listing.
6.5 Right of withdrawal (consumers). If you purchase as a consumer (a natural person acting outside a trade, business or profession), you have a statutory right to withdraw from the contract within 14 days without giving a reason. However, if you ask us to begin the Service (publish your Listing or start your membership) within that period, you expressly request immediate performance and acknowledge that you lose your right of withdrawal once the Service has been fully performed, and that for a Service performed in part you will owe a proportionate amount for what has been provided. Where the right applies, you can withdraw by emailing crew@gdpilots.com; we will refund any amount due within 14 days. This section does not apply to business customers.
6.6 Refunds. Except where the statutory right of withdrawal above applies, or where we fail to provide a Service we have charged for, fees are non‑refundable. We do not refund fees for Listings removed because they breached these Terms or the Website Rules.
7. Acceptable use of the Website
You agree to use the Website lawfully and in accordance with our Website Rules. In particular, you must not:
- scrape, harvest, copy or systematically extract data or Listings, whether manually or by automated means, except with our prior written consent;
- circumvent, disable or interfere with security features, the account/payment gate, or any access controls;
- upload malware or attempt to gain unauthorised access to the Website or its systems;
- misuse any personal data you obtain through the Website (see clause 11); or
- use the Website in any way that damages, overloads or impairs it.
8. Intellectual property
The Website and everything in it other than User Content — including its design, text, logos, layout and software — is owned by or licensed to GD Pilots and is protected by intellectual‑property law. You may not copy, reproduce or reuse it except as permitted by these Terms or by law. You retain ownership of your own Listing Content, subject to the licence in clause 5.5.
9. Third‑party links and content
The Website may contain links to third‑party websites or content. We do not control and are not responsible for third‑party websites, their content, or their privacy practices. Accessing them is at your own risk.
10. Availability and changes to the service
We aim to keep the Website available and working well, but we do not guarantee that it will be uninterrupted, error‑free or secure at all times. We may change, suspend, restrict or discontinue any part of the Website, and may carry out maintenance, at any time. Where reasonable, we will give notice of significant changes.
11. Personal data
Our handling of personal data is described in our Privacy Policy. Where you receive personal data through the Website (for example, application details or contact information from candidates), you act as an independent controller of that data and must comply with applicable data‑protection law, including the GDPR. You must use such data only for the relevant recruitment purpose and not for unrelated marketing or any unlawful purpose.
12. Disclaimers
The Website and the Services are provided “as is” and “as available”. To the extent permitted by law, we do not warrant that Listings are accurate, lawful or up to date (these are the responsibility of Employers), that the Website will meet your requirements, or that any particular result (such as applications or a successful hire) will be achieved. Nothing in this clause limits rights that cannot be limited under mandatory law, including consumer rights.
13. Liability
13.1 Nothing in these Terms excludes or limits our liability where it cannot lawfully be excluded or limited, including for intent or gross negligence on our part, for death or personal injury caused by our negligence, or under mandatory consumer law.
13.2 Subject to clause 13.1, and to the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, loss of business or opportunity, or loss or corruption of data, arising out of or in connection with the Website or the Services.
13.3 Subject to clause 13.1, and to the extent permitted by law, our total liability arising out of or in connection with the Services in any 12‑month period is limited to the amount you paid us for the relevant Service in that period (or, where no fee was paid, is limited to a reasonable amount reflecting the free nature of the Service).
14. Indemnity (business users)
If you use the Website in the course of a business, you agree to indemnify us against reasonable losses, costs and claims we suffer arising from your breach of these Terms or the Website Rules, from your Listings, or from your misuse of personal data obtained through the Website. This clause does not apply to consumers.
15. Suspension and termination
You may stop using the Website and close your Account at any time. We may suspend or terminate your access, and remove your Listings, if you materially breach these Terms or the Website Rules, if required by law, or to protect the Website, other users or third parties. Provisions that by their nature should survive termination (including clauses 5.5, 8, 11–14 and 17) continue to apply.
16. Changes to these Terms
We may update these Terms from time to time, for example to reflect changes in our Services or the law. We will post the updated Terms here with a new “last updated” date and, where the change is significant and you hold an Account, we will take reasonable steps to notify you. Continued use of the Website after the change takes effect means you accept the updated Terms. For existing paid agreements, material changes will not apply retroactively to a period already paid for.
17. Governing law and disputes
These Terms are governed by the law of the Netherlands, and disputes are handled as set out in our Netherlands Law — Legal Notice & Governing Law page, which also explains the options available to consumers. Please contact us first at crew@gdpilots.com so we can try to resolve any issue directly.
